Seasons Greetings,

The year is winding down quickly. I don’t know about you, but for us 2009 will go down as ….well, an interesting year.

As far as 2010 goes in the world of safety, all I can say is: "Hold on to your hats."  OSHA is ramping up and getting fired up. I dare say in the next few months we will be hearing more about the "Protecting American Workers Act". Expect some heated debate on the Hill over that one. We will most likely see a new Director of OSHA and lots of new regulatory activity. More on that in our coming issues of the newsletter. I also expect increased activity involving State Plan OSHA programs.

But for right now, all of us at Advanced Safety & Health want to wish you a Merry Christmas and a Safe Holiday Season.

EKU OSHA Training Institute Ed Center Continuing Classes in Louisville

The 2009 offering of the OSHA 500, 501, 502, 503, 510 and 511 classes held in Louisville were a huge success.  Eastern Kentucky University and Advanced Safety & Health have committed to conduct these classes throughout 2010 and beyond.  To see the 2010 schedule click here

Compliance Directive Issued
for Flu Prevention

OSHA Issues Compliance Directive to Address Flu Prevention for Healthcare Workers

For the protection of frontline healthcare and emergency medical workers at high risk of infection, in late November OSHA issued a compliance directive to ensure uniform procedures when conducting inspections related to the occupational exposures to the 2009 H1N1 influenza A virus.

In response to complaints, OSHA inspectors are being directed to assure that healthcare employers implement a hierarchy of controls and encourage vaccination and other work practices recommended by the CDC. Where respirators are required to be used, the OSHA Respiratory Protection standard must be followed, including worker training and fit testing. The directive also applies to institutional settings where some workers may have similar exposures, such as schools and correctional facilities.

Significant OSHA Inspection Activities

OSHA Fines Tempel Grain Elevators LLP More Than $1.6 Million
OSHA and the Wage and Hour Division together have fined Tempel Grain Elevators LLP of Wiley, CO more than $1.6 million following the May death of a teenage worker at the company's grain storage operation. The youth suffocated after being engulfed by grain in one of the facility bins.

Cement Bagging Plant Receives $509,000 in OSHA Fines
Cranesville Aggregate Co. in Scotia, NY faces a total of $509,000 in proposed fines from OSHA. The plant, which bags cement and asphalt, has been cited for 33 alleged willful, repeat, and serious violations following comprehensive OSHA inspections over the past six months.

Animal Feed Supplement Company Fined Over $470,000 for Combustible Dust Violations
Endres Processing LLC, has been cited by OSHA with violations that primarily involve exposing workers to combustible dust hazards.  Proposed fines total $472,900.

OSHA Cites Wheel Repair Shop with Failure-to-Abate and Repeat Violations
OSHA is proposing nearly $70,000 in penalties against Wheel Repair Solutions for seven failure-to-abate and three repeat violations while conducting a follow-up inspection.

West Lafayette Indiana Excavator Cited for Over $130,000
OSHA has cited Atlas Excavating Inc. in West Lafayette, IN with two alleged willful violations for failing to follow federal workplace safety standards at a trenching operation in Danville, IL.

Asbestos Hazards Net Contractor $484,000 in OSHA Penalties
OSHA issued citations to Cambria Contracting Inc. for 11 alleged willful violations of the OSHA construction asbestos standard for failing to train and protect its workers at a Buffalo jobsite. The Lockport, NY demolition contractor faces a total of $484,000 in proposed penalties.

E.On/LG&E Passport Training Program: Mondays on Dec 14, Jan 11, and Feb 8
We will continue to offer Passport training on the second Monday of each month.
 

Trenching and Excavation: Thursday, January 14
This course focuses on OSHA standards and on the safety aspects of excavation and trenching. Students are introduced to the requirements of the OSHA Construction standard subpart P – Excavations. This program focuses on the knowledge necessary to be a competent person on a jobsite. This is a high priority area for OSHA, so if you are involved in this type of work it is imperative that you are well versed on the rules and regulations. 

 

OSHA 10 Hour Construction: Wed, January 27 to Thur, January 28
This class is designed for personnel in the construction industry and covers information on how the provisions of the OSHAct may be implemented in the workplace focusing on workplace hazard recognition and abatement. Participants who successfully complete this course will receive an official course completion card from Federal OSHA.

OSHA 30 Hour Construction: Mon, Feb. 22 to Fri, Feb. 26
Designed for managers and supervisors who are responsible for the overall safety of their employees involved in construction work, this course presents detailed information on hazard identification, avoidance, and control. Participants who successfully complete this course will receive a course completion card from Federal OSHA.

OSHA Issues Clarification on Guarding
Access Opening for Fixed Ladders

Do you think the ladder access point to this platform meets the OSHA standard for guarding?

OSHA’s general industry standard dealing with walking and working surfaces 1910.23(c) "Protection of open-sided floors, platforms, and runways." Section (1) states the following: Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is an entrance to a ramp, stairway, or fixed ladder.

If you just read that section of the standard it would be reasonable to think you must have protection around all open sides of this platform except the entry point where there are stairs, ramps, or fixed ladders.

However, a recent memo written by Richard Fairfax, Director of OSHA Enforcement has a different take on this issue.

Scenario: You are the Safety Manager for your company and are responsible for completing the OSHA 300 Log. It is time for you to have your new Plant Manager sign the "Summary of Work-Related Injuries and Illnesses" Form 300-A so you can post it as required by the standard. You spent quite a bit of time explaining to him how the whole OSHA recordkeeping process works, and he demonstrated quite an interest in what you were doing and the types of injuries your plant was experiencing.

As you are leaving his office, he makes the following statement to you: "When it comes to safety, we have no secrets around here. I think it would be a great idea if you post the entire 300 Log along with the Summary so people see just exactly what type of injuries we are having."

Why'd They Do That? Photo of the Month

While we did blank out the face, there was no effort to Photoshop the cigarette in the individual’s mouth as he walked out of the flammable liquids storage room.  When we snapped the picture, the gentleman just walked into the path of our shot causing  us wonder "Why’d They Do That”?
